This refers to what supposedly is the first use (by an evil ACLU lawyer)of the phrase "separation of church and state." This event marked the death of the first amendment because, the argument goes, the phrase does not appear in the Constitution. A curious argument indeed. Here are some other phrases that don't appear in the Constitution yet they have (insidiously I guess, at least according to Sibby) crept into our lexicon as shorthand phrases for concepts that the Constitution does indeed embrace if not embody: federalism; states' rights; right to know; separation of powers. This crap about "the phrase doesn't appear in the constitution" so the concept or principle doesn't exist is just that---------crap.
